Please read these Terms and Conditions carefully before accessing, booking, or participating in any activities at **EKPE Activate Games** (“we”, “our”, “the venue”). By making a booking, purchasing a ticket, entering the venue, or participating in any activity, you acknowledge that you understand and agree to these Terms and Conditions.
1. General Conditions**
1. EKPE Activate Games is a high-energy interactive sports and challenge experience.
2. Entry to the venue is only permitted with a valid booking, membership, voucher, or approved walk-in purchase.
3. We reserve the right to refuse entry or remove any guest who violates our policies, behaves inappropriately, or creates safety risks.
4. All guests must follow instructions given by EKPE staff at all times to ensure safety and fairness.
2. Age Requirements**
1. Guests aged **18 years or older** must complete a **signed waiver** before entering.
2. Guests **under 18** must have a **parent or legal guardian** complete the waiver on their behalf before arrival.
3. Some challenge rooms may have height, age, or physical requirements. EKPE staff have the right to restrict entry for safety reasons.
3. Health & Safety**
1. Our activities involve physical movement, jumping, running, bending, and rapid reflex challenges.
2. Participation is at your own risk. By joining our activities, you confirm that:
* You are in good physical condition
* You do not have any medical conditions that may increase the risk of injury
* You understand the physical nature of our challenges
3. You must wear appropriate sports clothing and closed-toe shoes.
4. No food, alcohol, illegal substances, or dangerous items are permitted in the gaming areas.
5. Intoxicated guests will not be allowed to participate and may be asked to leave.
6. EKPE Activate Games is not responsible for personal belongings. Lockers may be provided but are used at your own risk.
4. Booking Policy**
4.1 Booking & Payments**
1. All bookings must be made through our official website or approved partners.
2. Full payment or deposit must be made at the time of booking.
3. The remaining balance (if any) must be paid **upon arrival before the game begins**.
4. Prices may vary depending on weekends, weekdays, seasons, special events, or promotions.
4.2 Adding Guests**
1. If you wish to add extra guests, you must contact us **at least 24 hours in advance**.
2. Additional guests are subject to availability and may require extra payment.
5. Refund, Reschedule & Cancellation Policy**
1. All bookings are **non-refundable** unless required by Australian Consumer Law.
2. Bookings may be rescheduled with **48 hours’ notice**, subject to availability.
3. No-shows or late arrivals (more than 15 minutes past the booking time) will forfeit the booking with no refund.
4. If EKPE Activate Games must cancel or reschedule due to safety, technical issues, or operational reasons, guests may receive:
* A full credit
* A rescheduled session
* Or a refund (case-by-case)
6. Venue Rules**
1. You may bring your own **water** only. No outside beverages or alcohol allowed.
2. Outside food is only permitted if you book an **official Party Package**.
3. Guests must treat all staff, equipment, and other players with respect.
4. Damage caused by misconduct may result in repair fees.
5. For private areas or designated lounges, an additional fee may apply.
7. Membership Terms**
1. EKPE Activate Games may offer free or paid memberships.
2. Current offer: **Membership is FREE for a limited time** before the official launch of the USD 9.99 membership fee.
3. Members enjoy exclusive perks, including:
* Weekly giveaways (members only)
* Members-only lucky draws
* Weekly free-ticket “Fast Grab” events
* Priority access to new events, games, and trials
4. Membership benefits may change from time to time.
5. EKPE reserves the right to update, modify, or terminate the membership program with prior notice.
8. Gift Cards, Promotions & Vouchers**
1. All gift cards and vouchers are non-refundable and cannot be redeemed for cash.
2. Promotional codes must be applied at checkout and cannot be added afterward.
3. Expired vouchers will not be accepted.
4. EKPE reserves the right to limit the use of discounts and special promotions.
9. Group Bookings & Parties**
1. For group bookings, corporate events, and party packages, a separate agreement or deposit may be required.
2. Additional rules may apply depending on the package selected.
3. Any decorations, food, or setup brought into the venue must be pre-approved.
10. Liability Waiver**
By participating, you agree that:
1. EKPE Activate Games is not responsible for injuries caused by normal physical activity, misuse of equipment, or failure to follow staff instructions.
2. You release EKPE from claims related to:
* Accidents
* Personal injury
* Loss or damage to personal belongings
3. You understand that activities involve inherent risks similar to sports and physical exercise.
11. Photo, Video & Marketing Use**
1. The venue may record photos or videos for safety or marketing purposes.
2. By entering, you grant EKPE permission to use your image for promotional materials unless you notify staff in writing before your session.
3. You may take personal photos/videos, provided you do not disturb other guests or violate privacy.
12. Behaviour & Code of Conduct**
1. Bullying, harassment, aggressive behaviour, or misuse of equipment will result in removal without refund.
2. Staff instructions must be followed at all times.
3. EKPE may refuse service to anyone engaging in unsafe, disrespectful, or disruptive behaviour.
13. Changes to Terms & Conditions**
We may update these Terms & Conditions at any time. Changes will be posted on our website with the “Last Updated” date. Continued use of our services indicates acceptance of the updated terms.
